The American Jewish Population Project (AJPP) is committed to protecting the privacy of the users of its website. To better inform you of our policy concerning user privacy, we have adopted the following guidelines, which adhere to the Safe Harbor Principles published by the U.S. Department of Commerce. Please note that these guidelines are subject to change, and any such changes will be included on this page and shall become effective 30 days following their posting on our website. All users will be notified by e-mail of any privacy policy changes and will have a way to opt out by removing their personal information from our records.
The personal information AJPP collects will depend on how you are using the AJPP website. We may collect certain non-personally identifiable information, such as the type of browser you are using (e.g., Netscape, Internet Explorer), and the type of operating system you are using (e.g., Windows or Mac). To create an account with AJPP, we collect your name, e-mail address, username, and password, as well as other information you may fill in. In addition, we may collect personally identifiable information through correspondence you send to us. However, unless you provide us with personally identifiable information, you remain anonymous to us other than by association with an internet protocol address or other authentication mechanism.
We use the personal information collected in ways that are compatible with the purposes for which it was intended to be used: to enable your use of the AJPP database; to create your AJPP account; to respond to your inquiries; for system administration, customer support, and troubleshooting purposes; for product service announcements; for sending newsletters to those who subscribe; to improve the design of our website; to enable us to enforce our Terms and Conditions of Use; and in aggregate form, to track and analyze site usage. AJPP will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.
AJPP employs "cookie" technology. Cookies are small pieces of text that are stored on your computer and act as a tool for controlling certain system variables and storing system configuration information in the WWW environment. AJPP uses cookies to store user preferences for viewing and to store authentication information. No personal information is extracted in the cookie setting process, and we do not use cookies to identify what other sites or pages you have visited. We do not involve advertisers, who may place a cookie on your browser, in the operation of our site. AJPP uses cookies to maintain information that will improve the performance of the system or benefit users in some way. Any personal information, other than what is voluntarily submitted, is not extracted in this process, and we do not use cookies to identify what other websites or pages you have visited.
AJPP does not sell or share personal information about or the individual users unless required to do so by law or if we believe in good faith that such action is necessary to comply with the law or a legal proceeding, to protect against violations of our Terms and Conditions of Use, or to protect and defend our rights and property or the rights and property of publishers selling content through the service;
AJPP may change the Terms and Conditions of Use, or any aspect of AJPP, at any time. The Registered User will have the option to renew registration with the revised Terms and Conditions. All versions of Terms and Conditions will be available on our website until deemed necessary.
By using our website, you consent to the collection and use, in accordance with this policy, of the information you provide to us. We will remove you and your personally identifiable information from our database or refrain from using your personally identifiable information in connection with certain services on request if you contact us with your request at ajpp@brandeis.edu. Please note that this may prevent you from accessing the AJPP database.
We protect your personal information from unauthorized access and disclosure through the use of passwords, physical security measures, managerial measures, and encryption. We nonetheless recognize that third parties may obtain access to information through unlawful actions, and thus do not promise that your information always will remain private, despite our efforts and the importance we place on maintaining your privacy. In addition, we do not claim any responsibility for information collected by or from websites linking to or from AJPP.
If you would like to review or update your information, you may contact us using the contact information below. We will take reasonable steps to permit you to correct, amend, or delete information that is demonstrated to be inaccurate. You will need to provide sufficient identifying information, such as your name and e-mail address and possible additional identifying information as a security precaution. We may limit or deny access to personal information where providing such access would be unreasonably burdensome or expensive under the circumstances, or as otherwise permitted by the Safe Harbor Principles.
We engage in periodic self-assessment to ensure compliance with our Privacy Policy. We verify that the policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented, and in conformity with the Safe Harbor Principles. We encourage interested persons to raise any concerns with us using the contact information below. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with the principles contained in this policy.
Any claim arising out of or relating to our adherence to the Safe Harbor Principles, or the breach thereof, that cannot be resolved through our internal processes will be settled by arbitration administered by the American Arbitration Association in accordance with its applicable commercial rules. Any arbitrator will be either an attorney or retired judge having significant and recognized experience with and knowledge of privacy issues and information technology. The arbitration panel should apply New York law, without regard to its conflict of laws principles, as well as the Safe Harbor Enforcement Principles issued by the U.S. Department of Commerce. In addition, the exclusive location for such arbitration will be New York, New York. All decisions of the arbitration panel will be final and binding on the parties, which waive any right to further appeal the arbitration award, to the extent an appeal may be lawfully waived.
If you have any questions about this Privacy Policy or its implementation, you may contact us at ajpp@brandeis.edu.
By registering to the American Jewish Population Project (AJPP) website, you shall be designated a "registered user," and you must accept and agree to abide by the following Terms and Conditions of Use:
AJPP registration enables access to an electronic database containing Content (as defined herein) and software that is designed to permit Registered Users to access, use, reproduce, display, and distribute such Content ("Access Software") for the limited purposes herein. Content includes all data available in the application, as well as text, graphics, slideshows, and all other materials posted on the AJPP website. AJPP hereby grants the Registered User a limited, nonexclusive license to access and use detailed data from AJPP, and to use, display, distribute, and reproduce the Content, solely in accordance with these Terms and Conditions of Use. The Registered User may not share, assign, or transfer their registration, and any attempt at such sharing, assignment, or transfer is void.
Registered User may not authorize access to AJPP Detailed Data (by sharing passwords or by other means) to anyone who is not a Registered User.
Should Registered User’s access to AJPP terminate or expire, the Registered User may keep only those print or electronic copies of Content appearing in lesson plans or in other pedagogical, educational, or scholarly materials for uses that are consistent with fair use and other exceptions to intellectual property rights laws, provided that such uses comply with the Terms and Conditions of Use, which shall survive the termination of access to AJPP.
The Registered User agrees not to modify, obscure, or remove any copyright notice or other attribution included in AJPP, and not to authorize others to do so.
The Registered User has no rights to the Access Software and its related documentation, other than the limited license granted herein. The Registered User may not copy, distribute, modify, decompile, reverse engineer, circumvent, override or disable encryptions or other protections in, or create derivative works from the Access Software. The Registered User may not access AJPP except through the Access Software.
The Registered User may establish links to facilitate access to Content by Registered User. Many researchers find links to be a helpful way to facilitate access to Content by a group of Registered Users. In addition, AJPP may be accessible from links within related or unrelated websites and resources. AJPP shall not be liable for any loss, injury, claim, liability, or damages of any kind arising out of or in connection with such links. AJPP may provide links to other websites for the benefit or convenience of its users. AJPP makes no representation or warranty of any kind, express or implied, with respect to such websites, and the linking to such websites shall not constitute any kind of endorsement of such sites. The Registered User should direct any concerns regarding any outside link to its site administrator.
The Registered User is responsible for maintaining the confidentiality and security of the Registered User’s username and/or password (if such are provided), and for all usage or activity by the Registered User, and the Registered User hereby agrees not to provide access to AJPP to anyone else. The Registered User may not set up an anonymous remailer for purposes of allowing access to AJPP. The Registered User may set up a proxy server to facilitate access to AJPP.
The Registered User shall promptly notify AJPP, of any known or suspected unauthorized use(s) of the Registered User’s account or AJPP, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure or use of The Registered User’s username, password, and/or IP address. Any use of AJPP beyond the scope or in violation of these Terms and Conditions of Use, knowing use of any password or username of another, or any fraudulent, abusive, or otherwise illegal activity, may be grounds for termination of the Registered User’s account, or termination of access to AJPP from the Registered User’s IP address, without notice and at AJPP's sole discretion. The foregoing includes but is not limited to activity by the Registered User that may burden AJPP's server(s) such as computer programs that automatically download or export Content, commonly known as web robots, spiders, crawlers, wanderers or accelerators.
The Registered User agrees that AJPP shall in no way be liable for any loss, injury, claim, liability, damages, costs, or attorneys' fees for the violation by the Registered User of these Terms and Conditions of Use, or any use of AJPP that exceeds the Terms and Conditions of Use.
AJPP will not be held liable for any delays, inaccuracies, errors or omissions in AJPP or Content, in the transmission or delivery of all or any part thereof, or for any damages arising from any of the foregoing.
In addition to the provisions in section 6 herein, AJPP may withdraw Content from AJPP for good cause shown. AJPP would endeavor, to the extent practicable, to minimize any inconvenience to Registered Users caused by such withdrawal by, for example, seeking to withdraw Content at the end of year or when there are new releases of data. However, should AJPP be unable to avoid such inconvenience, the Registered User shall in no way hold AJPP liable for the withdrawal of such Content from AJPP.
The Registered User’s use of AJPP indicates the Registered User’s acceptance of AJPP's Privacy Policy, as it may be amended from time to time. AJPP's Privacy Policy provides in part that AJPP may disclose information about usage of AJPP and demographics pertaining thereto so long as such disclosure does not reveal users' personal identities, unless such disclosure is required to protect against violations of this Agreement, or to protect and defend AJPP's rights or property, or the rights or property of third-party rights holders and contributors to AJPP, is reasonably necessary for pursuing a claim or investigation concerning alleged violation(s) of the Terms and Conditions of Use or is in response to a subpoena, court order, or other legal proceeding, or otherwise as set forth in the Privacy Policy. Should the Registered User choose to use some optional functions in AJPP, the Registered User may be required to provide the Registered User’s e-mail address. For more information on monitoring and gathering usage data, see AJPP's Privacy Policy.
Nothing in this Agreement should be construed or interpreted to limit those uses of Content printed or exported from AJPP that are permitted under the fair use, educational exceptions, or other provisions to the copyright laws or other intellectual property right laws in the United States or in other countries, but the Registered User makes such uses at the Registered User’s own risk. Nothing in these Terms and Conditions of Use should be construed as AJPP authorizing the Registered User to incorporate Content into electronic or print materials that are for purchase or are disseminated for commercial purposes (such as by a scholarly or commercial press), to make any commercial use of AJPP or Content therein, or to make any use, display, performance, reproduction, or distribution of AJPP or Content therein not expressly authorized in these Terms and Conditions of use. Copyright is not claimed by AJPP as to any work of the United States government, or to any work that is in the public domain. The Registered User expressly acknowledges and agrees that AJPP shall not be liable in any way for all uses that the Registered User makes of the Content that exceeds these Terms and Conditions of Use, whether or not the Registered User is relying on fair use and/or other provisions of the United States copyright or other intellectual property rights laws.
AJPP may change the Terms and Conditions of Use, or any aspect of AJPP, at any time. Registered Users will be notified prior to changes taking effect and will be provided the option to renew registration with the revised conditions. All versions of Terms and Conditions will be available on our website until deemed necessary.
